These Terms of Use govern your access to skjoldmark.com and the online services Skjoldmark Cargo Assurance, Inc. provides through it. By opening or using the site you agree to be bound by them. If you do not agree, please do not use the site.

Accepting these terms

Every time you access the site you confirm that you will comply with these Terms of Use and with our Privacy Policy, and that both documents bind you.

Information only

Cover descriptions, the savings calculator, case studies and worked examples on this site are general information. None of it constitutes a quotation, a binder, a certificate or an offer to insure. Cover exists only when underwriting has been completed, and it is governed exclusively by the wording, conditions, exclusions and endorsements of the policy issued at binding.

Intellectual property

The text, graphics, logos, icons, images, audio and video, data compilations and software on this site are owned by Skjoldmark Cargo Assurance, Inc. or its licensors and protected by copyright and other intellectual-property laws.

The material is published for your information. Except for viewing it for your own non-commercial purposes, or as otherwise permitted by law, you may not reproduce, distribute, modify or reuse it without our prior written consent.

Acceptable use

When using this site you agree not to:

• Upload, post, transmit or link to material that infringes another person’s intellectual property, privacy, publicity or other rights.
• Distribute content through the site that is unlawful, defamatory, obscene or otherwise objectionable.
• Disrupt or interfere with the operation of the site or the servers and networks that support it.
• Attempt unauthorized access to any part of the site, to user accounts, to connected systems or to the networks that serve them, whether by hacking, password mining, credential stuffing or any similar technique.
• Deploy bots, scrapers, crawlers or other automated tools against the site without our express written permission.
• Misrepresent your identity, your organization, your authority or your intentions when requesting quotes or submitting information.

Third-party sites and tools

The site may link to third-party websites, broker portals, carrier tracking tools or partner platforms. Those services are operated by others. We do not control their content, privacy practices, security or availability, and your use of them is governed by their own terms.

Your commitments as a policyholder

Purchasing or binding a policy through Skjoldmark places the following commitments on you:

1. Comply with the coverage rules: the conditions, limits, exclusions and documentation requirements set out at enrolment, in your policy documents, in endorsements and in the claims process.
2. Read your policy: you are responsible for reviewing the terms that apply to your goods, lanes, commodities and trading activity.
3. Track changes: coverage rules and program guidelines may be updated. Material changes are announced on the site, through your broker, by email or via the other contact details we hold for you.
4. Tell us what changes: notify us promptly of changes to your shipping profile, values, commodities or anything else that may affect cover or premium.
5. Use the claims process: submit claims with the required documentation within the stated deadlines. Missed steps can affect how a claim is decided.
6. Escalate through us first: questions about cover or a claims decision should be raised initially with cover@skjoldmark.com or +1 (206) 555-0172.

Our commitments to you

As your cargo insurer, Skjoldmark in turn commits to:

1. Act within the law: conducting the business in accordance with applicable insurance law and regulation, including fair claims handling and statutory record keeping.
2. Protect your data: maintaining reasonable safeguards against unauthorized access, alteration, loss or disclosure of client information, as described in our Privacy Policy.
3. Retain records responsibly: keeping records for the periods required by law and industry practice, then deleting or anonymizing them when retention is no longer necessary.
4. Communicate plainly: providing clear information about the material terms of cover and about any changes that may affect your policy, wherever practicable.

Disclaimer of warranties

The site and its content are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, title and non-infringement, and we do not guarantee that the site will operate uninterrupted or error-free, or that it will be free of harmful code.

Limitation of liability

To the extent permitted by law, Skjoldmark Cargo Assurance, Inc. and its affiliates, officers, employees and agents are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of this website. For direct damages connected with site use, our total liability is limited to the greater of the amount you paid us for online services in the twelve months before the claim arose or one hundred U.S. dollars, except where the law prohibits such a limitation.

Indemnification

You agree to indemnify and hold harmless Skjoldmark Cargo Assurance, Inc. from claims, losses, liabilities and expenses, including reasonable attorneys’ fees, arising from your breach of these terms or misuse of the site, except to the extent caused by our own gross negligence or willful misconduct.

Governing law

These terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law principles. Where mandatory local law applies to an insurance contract you hold with us, that law governs that contract.

Amendments

We may revise these terms at any time. Updated terms are posted on this page and take effect when published, so please check back periodically.
